These terms apply when you access or use AUTO.KLUBIS, including its vehicle marketplace and Vehicle history & PPSR report service. By using the service, you agree to these terms.
Eligibility and accounts
You must be at least 18 and able to enter a binding agreement. You must provide accurate information, keep your login details and verification codes secure, and tell us promptly if you suspect unauthorised access. You are responsible for activity through your account.
Marketplace role
AUTO.KLUBIS provides a platform for dealers and private sellers to advertise vehicles and for buyers to contact them. Unless expressly stated, we are not the buyer, seller, dealer, agent or owner of an advertised vehicle and are not a party to the sale contract. Users are responsible for inspections, negotiations, contracts, payment, transfer, registration, insurance and compliance with applicable law.
Seller obligations
A seller must have authority to advertise the vehicle and must provide accurate, current and lawful information, including seller status, price, condition and material facts. A seller must not publish misleading content, duplicate or unavailable listings, unlawful material, or content that infringes another person’s rights. We may review, reject, edit, suspend or remove listings to protect users and the service.
Buyer responsibilities
Buyers must independently confirm a vehicle’s identity, condition, ownership, price, inclusions and availability. Arrange an inspection, verify the seller, review original documents and use safe payment methods before committing to a purchase.
Vehicle history and PPSR reports
Reports are a separate service and may be purchased for vehicles that are not advertised on AUTO.KLUBIS. Report information comes from government registers, licensed data providers and other independent sources. A report reflects information available for the searched registration or VIN at the stated time. It may contain delays, omissions or errors and is not a mechanical inspection, valuation, ownership guarantee or substitute for professional advice and due diligence.
You must enter vehicle identifiers carefully and confirm the returned vehicle before relying on or purchasing a report. Subject to rights that cannot be excluded, we are not responsible for a report generated from identifiers you entered incorrectly.
Prices, payments and refunds
Prices are shown in Australian dollars and include GST where applicable. Payments are processed by Eway or another disclosed payment provider. You authorise the applicable charge when placing an order. Refunds are provided where required by the Australian Consumer Law and may also be considered where we cannot supply the purchased service. Change-of-mind refunds may not be available after a report has been generated or supplied.
Acceptable use
You must not use the service unlawfully or fraudulently, scrape or harvest data, send spam, impersonate another person, interfere with security or operation, introduce malicious code, reverse engineer protected components, or use report data for an unauthorised commercial purpose.
Intellectual property
AUTO.KLUBIS owns or licenses the platform, branding, design and service content. You retain ownership of content you submit and grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it as needed to operate and promote the service. You confirm that you have the rights needed to grant that licence.
Availability and liability
We may change, suspend or discontinue features and cannot promise uninterrupted or error-free access. To the maximum extent permitted by law, we exclude implied warranties and liability for indirect or consequential loss. Where liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant service or paying the cost of resupply. Nothing in these terms excludes non-excludable rights under the Australian Consumer Law.
Suspension and termination
We may restrict or terminate access where we reasonably believe these terms have been breached, the service or another person is at risk, or the law requires it. You may stop using the service and request account closure, subject to records we must or may lawfully retain.
Governing law
These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction.
